This Customer Rental & Service Agreement (“Agreement”) is entered into between Cascadia Crates LLC, a Washington Limited Liability Company (“Cascadia Crates,” “we,” “us,” or “our”), and the customer identified on the applicable rental order (“Customer,” “you,” or “your”).
By placing an order, making a payment, accepting delivery, or using Cascadia Crates rental equipment, Customer acknowledges that they have read, understood, and agree to be bound by this Agreement.
1. TERMS OF USE
Cascadia Crates LLC provides reusable plastic moving totes and related equipment rental services for residential and commercial moves and other approved uses.
Rental equipment is provided for temporary use only and is not sold or transferred to Customer.
By placing an order, Customer accepts responsibility for the rental equipment from the time it is delivered or otherwise provided to Customer until it is returned to or collected by Cascadia Crates.
Customer agrees to use the equipment responsibly and return all equipment in substantially the same condition in which it was received, except for normal wear and tear.
2. RENTAL PERIOD
Rental periods are established at the time of booking.
Customer is responsible for returning or making all rental equipment available for pickup by the scheduled end date.
If Customer needs additional rental time, Customer should notify Cascadia Crates at least 48 hours before the scheduled pickup date whenever reasonably possible.
Rental extensions are subject to equipment availability and approval by Cascadia Crates. Additional rental charges will apply based on the applicable rental rates and length of the approved extension.
3. PAYMENT
Full payment is due at the time of reservation unless otherwise agreed in writing by Cascadia Crates.
Payments may be made using the payment methods offered through Cascadia Crates’ secure online payment system.
Customer authorizes Cascadia Crates to charge the payment method on file for amounts properly due under this Agreement, including:

Rental charges
-
Approved rental extensions
-
Applicable late charges
-
Cleaning fees
-
Damage charges
-
Missing or unreturned equipment
-
Replacement charges
-
Additional delivery or pickup fees
-
Service or trip fees permitted under this Agreement
This authorization applies to legitimate charges under the agreement after the rental.
An itemized receipt will be provided upon request.
4. DELIVERY
Cascadia Crates will deliver the rental package to the address provided by Customer during checkout or on the applicable rental order on the scheduled delivery date.
Customer agrees to provide accurate delivery information and ensure reasonable and safe access to the delivery location.
Delivery is available within Cascadia Crates’ designated service area. Additional fees may apply for locations outside the standard service area.
Cascadia Crates reserves the right to decline or postpone delivery when conditions present an unreasonable safety risk to employees, contractors, Customer, or property.
5. NO MOVING SERVICES
Cascadia Crates provides rental equipment and delivery/pickup services only and does not provide moving, packing, loading, unloading, or transportation of Customer's personal property. Customer is solely responsible for packing, loading, securing, transporting, unloading, and handling Customer's belongings.
6. PICKUP AND RETURNS
At the end of the rental period, Cascadia Crates will pick up the reusable totes and rental equipment from the scheduled location unless other arrangements have been approved in advance.
Before pickup, Customer must:

Empty all totes.

Nest totes together where applicable.

Keep equipment reasonably accessible.

Ensure there is safe and reasonable access to the pickup location.

Have all rental equipment ready at the scheduled pickup time.
Customer is responsible for ensuring that all rented equipment is available for pickup.
If no one is available when required, equipment is inaccessible, access is blocked, pets are unsecured, unsafe conditions exist, or incorrect or incomplete information was provided, Cascadia Crates may charge an additional pickup, trip, or service fee.
7. RESCHEDULING
If Customer needs to change the scheduled delivery or pickup date, Customer should contact Cascadia Crates as soon as possible.
Cascadia Crates will make reasonable efforts to accommodate the requested change based on equipment availability and scheduling.
There is no rescheduling fee when the requested date is available and the change can be accommodated without additional service costs.
A requested change is not guaranteed until confirmed by Cascadia Crates.
8. CANCELLATIONS AND REFUNDS
Cascadia Crates understands that moving and event plans can change. Our cancellation policy is intended to provide reasonable flexibility while allowing us to reserve inventory for each customer.

Cancellations made 72 Hours or More Before Delivery: Full refund
-
Cancellations Less Than 72 Hours but at Least 24 Hours Before Delivery: 50% refund
-
Cancellations Less Than 24 Hours Before Delivery: No refund
Any applicable refund will generally be issued to the original payment method.
9. WEATHER AND UNFORESEEN DELIVERY ISSUES
If weather, road conditions, emergencies, equipment damage or failure, or other unforeseen circumstances affect Cascadia Crates’ ability to complete a scheduled delivery or pickup, Cascadia Crates will make reasonable efforts to communicate with Customer and reschedule the service.
If Cascadia Crates is unable to fulfill an order because of circumstances outside its reasonable control, Cascadia Crates may reschedule the rental or provide a full refund for the affected order or service.
10. CUSTOMER RESPONSIBILITIES
Customer agrees to:

Use the rental equipment only for lawful and approved purposes.

Use the equipment in a safe and reasonable manner.
-
Keep equipment in a safe and secure location while in Customer’s possession.
-
Protect equipment from theft, fire, flooding, excessive heat, and other conditions that could cause damage.

Return or make all equipment available for pickup by the scheduled return date.

Notify Cascadia Crates promptly if any equipment is lost, stolen, damaged, or otherwise becomes unusable.

Use appropriate lifting and handling techniques.
-
Avoid overfilling totes or using them in a manner that could cause damage or injury.
-
Keep rental equipment reasonably accessible for scheduled pickup.
Customer shall not:
-
Paint, drill, cut, or permanently modify rental equipment.
-
Use rental equipment for hazardous or unlawful purposes.
-
Use equipment to store hazardous materials, chemicals, explosives, or other dangerous substances.
-
Not leave rental equipment unattended in a location where it is reasonably likely to be stolen, damaged, or exposed to hazardous conditions.
-
Use equipment for construction, industrial purposes, or commercial freight unless specifically approved by Cascadia Crates.
-
Sub-rent, loan, transfer, or give possession of rental equipment to another person without prior written permission from Cascadia Crates.
11. CLEANING
Normal dirt and reasonable signs of use associated with moving are expected.
Customer may be charged a reasonable cleaning fee when equipment requires excessive or unusual cleaning due to contamination, misuse, or substances that require special cleaning.
Examples include:

Paint
-
Oil or grease
-
Concrete
-
Chemicals
-
Mold
-
Animal waste
-
Food contamination
-
Other substances requiring specialized cleaning
12. EQUIPMENT CONDITION & DOCUMENTATION
Cascadia Crates may photograph or otherwise document the condition of rental equipment before delivery, at delivery, during pickup, and after return or collection for purposes of documenting equipment condition, damage, missing or unreturned items, excessive cleaning requirements, and applicable charges under this Agreement.
Customer agrees to reasonably cooperate with requests to inspect or document rental equipment.
Customer must notify Cascadia Crates within 24 hours after delivery if any equipment is damaged, missing, or not in reasonably good and usable condition. Unless Customer reports a pre-existing issue within that 24-hour period, the equipment may be presumed to have been received in good and usable condition, except for normal wear and tear.
13. DAMAGE, LOSS, AND THEFT
Customer is responsible for the care and safekeeping of all rental equipment from the time of delivery or possession until the equipment is returned to or collected by Cascadia Crates.
Customer may be charged for equipment that is:

Lost
-
Stolen
-
Destroyed
-
Broken
-
Defaced
-
Damaged beyond normal wear and tear
-
Otherwise rendered unusable
Reusable Totes
Totes returned broken, defaced, or otherwise unusable will be charged at a flat replacement rate of $15.00 per tote.
Dollies and Other Equipment
Lost, stolen, destroyed, or damaged dollies may be charged at the stated replacement value of $50.00 per dolly. Other rental equipment may be charged at its applicable replacement value or reasonable repair cost.
Customer agrees to notify Cascadia Crates immediately upon discovering that any equipment has been lost, stolen, or damaged.
14. LATE RETURNS AND UNRETURNED EQUIPMENT
Equipment that is not returned or made available for pickup by the agreed rental end date may continue to accrue rental charges until returned or recovered.
Additional charges will be based on Cascadia Crates' then-current rental rates unless otherwise agreed in writing.
If equipment remains unreturned for thirty (30) days and Cascadia Crates is unable to contact Customer using the contact information provided, the equipment may be deemed unreturned and replacement charges may be assessed in addition to accrued rental charges, subject to applicable law.
15. SECURITY DEPOSIT
A security deposit may be required for certain rentals.
When applicable, the security deposit may be applied toward unpaid rental charges, cleaning fees, damage, missing equipment, replacement costs, or other amounts properly due under this Agreement.
Any remaining balance will be refunded after the equipment has been returned and inspected.
16. ASSUMPTION OF RISK AND SAFE USE
Customer understands that moving and handling totes, furniture, boxes, and other belongings may involve lifting, carrying, pushing, pulling, loading, unloading, and handling heavy or awkward items.
Customer is responsible for using the rental equipment safely and for determining whether Customer or anyone assisting with the move is capable of safely handling the items being moved.
Customer acknowledges that misuse, improper loading, overfilling, unsafe lifting, or improper handling of rental equipment may result in injury or property damage.
17. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable Washington law, Cascadia Crates LLC shall not be liable for indirect, incidental, special, or consequential damages arising from the rental or use of the equipment.
Cascadia Crates LLC is not responsible for injury or property damage resulting from Customer’s misuse, negligence, improper loading, improper handling, or unsafe use of the rental equipment.
Customer is responsible for Customer’s personal property and belongings during packing, loading, unloading, moving, and use of the rental equipment.
Nothing in this Agreement limits or excludes liability that cannot lawfully be limited or excluded under applicable law.
18. HOLD HARMLESS AND INDEMNIFICATION
To the fullest extent permitted by law, the Customer agrees to assume responsibility for the rental equipment during the rental period and to release, defend, indemnify, and hold harmless Cascadia Crates LLC, its owners, members, employees, agents, and representatives from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising out of or related to the Customer's possession, use, misuse, loading, unloading, movement, storage, or return of the rental equipment, except to the extent caused by the negligence or willful misconduct of Cascadia Crates LLC.
The Customer is responsible for ensuring that the rental equipment is used safely and appropriately and agrees not to use the equipment in a manner that could reasonably result in injury, property damage, or damage to the equipment. The Customer is also responsible for any loss, theft, destruction, or damage to the rental equipment while it is in the Customer's possession or control, subject to the terms of this Agreement.
This provision does not release Cascadia Crates LLC from liability that cannot legally be waived or transferred under applicable Washington law.
19. SERVICE AREA
Cascadia Crates provides delivery and pickup within its designated service area.
Service availability may vary by location. Additional delivery or pickup charges may apply for locations outside the standard service area.
Any applicable service-area charges will be disclosed during the booking process or before the rental is confirmed.

21. OWNERSHIP OF EQUIPMENT
All rental totes, dollies, and other rental equipment remain the sole property of Cascadia Crates LLC.
Nothing in this Agreement grants Customer any ownership interest in the rental equipment.
Customer agrees not to sell, transfer, pledge, alter, dispose of, or otherwise treat the rental equipment as Customer’s own property.
22. GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Washington.
Any legal action arising from or relating to this Agreement shall be brought in an appropriate state or federal court located in Washington, unless otherwise required by applicable law.
23. ENTIRE AGREEMENT
This Agreement, together with the applicable rental order, reservation details, pricing, and any written terms expressly incorporated into the rental, constitutes the entire agreement between Cascadia Crates LLC and Customer concerning the rental.
This Agreement supersedes prior oral or written discussions concerning the same rental, except for written terms expressly incorporated into the applicable rental order.
Any modification to this Agreement must be agreed to in writing by both parties.
24. SEVERABILITY
If any provision of this Agreement is determined to be invalid or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in full force and effect.
25. CUSTOMER’S PERSONAL PROPERTY
Cascadia Crates does not take possession of, transport, pack, load, unload, or assume responsibility for Customer's personal property. Customer is solely responsible for the care, protection, loading, transportation, unloading, and handling of Customer's belongings.
26. CUSTOMER ACKNOWLEDGMENT
By checking the acknowledgment box on the booking form, Customer confirms that Customer:

Has read and understands this Agreement.

Agrees to all terms and conditions contained herein.

Understands and agrees to the Cancellation & Refund Policy.

Understands that all rental equipment remains the property of Cascadia Crates LLC at all times.

Accepts responsibility for the rental equipment while it is in Customer’s possession, custody, or control.

Agrees to return the rental equipment or make it available for pickup as required under this Agreement.
-
Understands the applicable damage, loss, cleaning, late-return, and replacement charges.
-
Understands and accepts the risks associated with moving and using rental equipment.
27. ELECTRONIC ACCEPTANCE
By checking the acknowledgment box on the booking form and submitting a booking, Customer provides electronic acknowledgment and acceptance of this Agreement and agrees to be bound by its terms and conditions. Customer’s electronic acceptance shall have the same effect as a written signature to the extent permitted by applicable law.
Cascadia Crates LLC may retain a record of Customer’s booking and electronic acceptance of this Agreement.
